What is an eBike?

An eBike (electric bike) looks like a regular pushbike but has a small electric motor and a rechargeable battery that gives you a boost while you pedal. They’re fast, fun, and increasingly popular — with younger riders, and with people riding for food-delivery work. But that extra speed means everyone needs to know the rules.

Not every “electric bike” you see is legal to ride on Australian roads. Here’s what the law says.

A road-legal eBike — formally called an EPAC (Electrically Power-Assisted Cycle) — must meet three rules that are consistent across every Australian state and territory:

  • Have a motor rated at 250 watts (W) maximum continuous power
  • Have a motor that automatically stops assisting once you reach 25 km/h
  • Have pedals that the rider can actually use to propel the bike

These three requirements are drawn from the international EN 15194 standard, which Australia has adopted nationally. A federal import ban from December 2025 means all new eBikes entering Australia must meet this standard.

NSW — 500W legacy rule: NSW previously allowed 500W motors. If you or your family purchased a 500W eBike before 1 March 2026, it can still be legally ridden in NSW until 1 March 2029. After that date, all eBikes over 250W become illegal on NSW roads and paths. No other state has this legacy allowance — if you’re riding outside NSW, 250W is the limit regardless of when the bike was purchased.

If a bike’s motor pushes it beyond 25 km/h without pedalling, or has a throttle that runs the motor without pedalling above walking pace, the law treats it as a motorbike — not a bicycle. That means it needs registration, a licence plate, and a rider’s licence to be used legally on public roads.

Many riders — especially younger riders and those who’ve been given a secondhand bike — end up on bikes that don’t meet the legal definition of an eBike. This is more common than most people realise, and the consequences are serious: a non-compliant eBike isn’t just a legal problem, it’s a safety risk with a fundamentally different risk profile.

Red flags that an eBike may be non-compliant:

  • It moves without you pedalling (above walking pace). A legal eBike motor only assists when you pedal. If a throttle moves the bike without pedalling at speeds above about 6 km/h, it’s likely not a legal EPAC.
  • It keeps going faster than 25 km/h without extra pedalling effort. Legal motors cut out at 25 km/h — if the motor keeps assisting beyond that, the speed limiter has been removed or bypassed.
  • It feels very powerful compared to a regular eBike. Legal motors are 250W maximum. Bikes with 500W, 750W, or 1000W motors are a different machine — heavier, faster, and with aggressive acceleration that makes them far harder to control.
  • It was bought cheaply online without certification paperwork. Bikes without an EN 15194 certification mark are far more likely to be non-compliant.
  • No one knows its history. A secondhand eBike with no documentation could be anything.

If you’re not sure whether a bike is legal, don’t ride it on roads or paths until you’ve checked. Ask the retailer or contact your state’s transport authority.

Why it matters beyond the fine: An overpowered, throttle-only eBike is closer in behaviour to a small motorbike than a bicycle. It’s heavier, faster, and operates without the licence, registration, insurance, or safety equipment that motorbikes require. In NSW, police have had powers to seize and crush non-compliant bikes on the spot since the law passed in May 2026.

Throttle exception: Most states allow a “walk-assist” throttle that works up to 6 km/h only — for pushing the bike up a gutter or steep driveway. Victoria, South Australia, and Tasmania additionally permit a separate “power assisted cycle” (PAC) category: throttle-only bikes with motors up to 200W. These are different from EPACs and have their own rules.

Riding for food delivery? Many bikes sold for or used in delivery work have a throttle, or a motor well above 250W. On public roads and paths across Australia, that makes them illegal to ride without registration and a licence. If you ride an illegal bike for work, you are the one who can be fined and have the bike taken away — not the platform you deliver for. Before you start a shift, check that your eBike meets the three rules above.


Why does safety matter?

eBikes are faster than regular pushbikes. That extra speed changes everything:

  • You cover more ground in less time
  • It takes longer to stop
  • Drivers and pedestrians may not expect you moving that fast
  • A crash at 25 km/h hurts a lot more than one at 15 km/h

Lithium-ion battery fires from eBikes and e-scooters are a growing safety issue across every state. NSW Fire and Rescue attended 318 battery fires in 2024 — up from 272 the year before — and fire services in Victoria, Queensland, and WA are recording similar year-on-year increases. Most are caused by incorrect chargers, damaged batteries, or charging left unattended.

The good news: most accidents and fires are preventable when riders know the rules and take basic precautions. That’s exactly what this course covers.


What the current transition rules mean for you

Australian eBike law is in a period of change. Here’s what it means depending on your situation:

If you ride in NSW on a 500W eBike bought before 1 March 2026: Your bike is legal until 1 March 2029 — but only in NSW. If you cross into Queensland, Victoria, or any other state, your 500W bike is immediately over the legal limit. After 1 March 2029, it becomes illegal in NSW too. Start planning to transition to a 250W-compliant bike before then.

If you’re buying a new eBike anywhere in Australia: Since December 2025, all newly imported eBikes must comply with the EN 15194 standard (250W, 25 km/h cut-out). From February 2026, new eBikes sold in NSW must carry certification markings. If a retailer is selling a new, uncertified eBike, that’s a red flag.

If you ride a shared or hire eBike: Most hire fleets are certified. However, some older fleet bikes pre-dating the 2025/2026 rules may be 500W class. This doesn’t affect your right to ride them — the operator is responsible for compliance — but it’s worth knowing that a 500W hire bike behaves differently (more power, heavier) than a 250W bike.

If you ride in Queensland: Queensland’s new rules arrive in two stages. Since 1 July 2026, a 12 km/h footpath speed cap applies (fines $345–$1,986) and police can breath-test riders. From 31 August 2026, riders aged 16+ need at least a learner driver licence, and under-16s cannot ride on public roads and paths — a supervised-riding exemption for ages 12–17 is being finalised. Medical and physical factors

Most people can ride an eBike safely. But some medical conditions and medications can affect the same things that safe riding depends on: balance, coordination, reaction time, and the ability to make fast decisions.

Some medications cause drowsiness, affect balance, or carry a warning not to operate machinery — antihistamines, anxiety meds, strong painkillers, and vertigo medications are common ones. If you take something regularly that fits that description, check with your GP or parent before riding. Being on medication doesn’t automatically mean you can’t ride; it just means it’s worth knowing before you find out mid-ride.

If you’ve recently had a head injury, inner ear problem, or a medical event affecting your reflexes or coordination, get clearance from your treating doctor before getting back on an eBike.


Plan your journey — before you leave

The safest ride is one you’ve thought about for 30 seconds before you start. This habit costs almost nothing and prevents most of the avoidable problems riders run into.

Before every ride, run through this:

  1. Is my battery charged enough? Check the display. Do you have enough for the round trip — including hills, headwinds, and any extra stops? Below 20%? Charge first.
  2. What time will I get back? If your return might fall at or after sunset, sort out your lights before you leave — not when you’re already out in the dark.
  3. Do I know the route? A quick 30-second look before you go means you’re not making navigation decisions in traffic. Google Maps and Ride With GPS both show bike paths.
  4. What’s the weather doing? Rain, strong wind, or extreme heat changes how you should ride — and sometimes whether you should ride at all.
  5. Is anything wrong with the bike? A quick scan of your tyres, brakes, battery, and lights beats discovering a problem mid-ride. You’ll build up to the full ABCDE pre-ride check across the course — this step falls under E (Everything else) — and the complete framework is covered in Module 3.

On longer rides, let someone know where you’re going and when you’ll be back.

500 W legacy rule

This exemption applies in NSW only. No other state or territory has a legacy allowance — the 250 W limit applies immediately everywhere else in Australia, regardless of when the bike was purchased.
